To provide our global clientele with factory-direct pricing on advanced hair-care technology, we utilize an international fulfillment model. By accessing our Services, you acknowledge that while our administrative headquarters are located in Delaware, USA, our products are sourced and dispatched from premium global manufacturing hubs.

2. MEDICAL & SAFETY DISCLAIMER (EMS/RED LIGHT TECHNOLOGY)

Our products, including the Scalp Therapy Pro, are marketed exclusively as cosmetic wellness tools.

  • NOT A MEDICAL DEVICE: LumaNYC products are not intended to diagnose, treat, cure, or prevent any medical condition or scalp disease. Individual results will vary based on biological factors.

  • EMS SAFETY: Our devices utilize Microcurrent (EMS) technology. You are strictly advised NOT to use these devices if you have a pacemaker, an implanted electronic device, are pregnant, or have a history of seizures.

  • LIABILITY WAIVER: LumaNYC is not liable for individual skin sensitivities, allergic reactions to topical elixirs, or adverse effects resulting from pre-existing medical conditions. Use of our products is at the sole risk of the consumer.

3. INTELLECTUAL PROPERTY

All content, including but not limited to logos, product descriptions, imagery, and the "LumaNYC" trademark, is the exclusive intellectual property of the Company. Unauthorized reproduction or "brand-squatting" will be prosecuted to the fullest extent of the law.

4. LIMITATION OF LIABILITY & INDEMNIFICATION

To the maximum extent permitted by law, LumaNYC, its directors, and affiliates shall not be liable for any direct, indirect, or consequential damages arising from the use or inability to use our products. You agree to indemnify, defend, and hold harmless LumaNYC from any third-party claims, damages, or legal expenses (including attorney’s fees) arising from your breach of these Terms or your misuse of our hair-care technology.

5. GOVERNING LAW & JURISDICTION

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States. You agree that any legal action or proceeding arising out of these Terms shall be brought exclusively in the courts located in Wilmington, Delaware.

IMPORTANT: MANDATORY ACKNOWLEDGEMENT & BINDING AGREEMENT

PLEASE READ CAREFULLY: By accessing this website and/or finalizing a purchase with LumaNYC, you hereby represent, warrant, and certify that you have read, understood, and unequivocally agreed to be legally bound by all terms, conditions, and policies stated herein.

  1. FINALITY OF AGREEMENT: Your successful checkout constitutes a legally binding digital signature. This confirms your acceptance of our Hygiene & Safety (No-Return) Policy and our International Logistics Timelines.

  2. WAIVER OF CLAIM: You expressly acknowledge that a "failure to read" these policies does not constitute valid grounds for a refund, return, or credit card dispute. You hereby waive any right to claim "Item Not as Described" regarding shipping durations or hygiene-related return denials that are explicitly outlined in our documentation.

  3. MEDICAL CONSENT: You confirm that you have read the medical disclaimers regarding EMS technology and assume full personal liability for the application and use of our electronic devices.

  4. DISPUTE RESOLUTION: You agree to contact support@lumanyc.shop to resolve any grievances prior to initiating a chargeback. Unauthorized or fraudulent chargebacks will be contested using your IP address and this signed agreement as evidence of a valid contract.

IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY, YOU ARE LEGALLY INSTRUCTED TO DISCONTINUE USE OF THIS SITE AND REFRAIN FROM PLACING AN ORDER.
